Faus Patent Sucess In China

Calhoun, GA - Faus is pleased to announce that, on June 20, 2008, the State Intellectual Property Office ("SIPO") in China confirmed the validity of claims of Faus Chinese Patent 02815741.9, which covers the process for manufacturing Embossed in Register laminate flooring products.
An opposition to invalidate this Patent was filed last year by the Hangzhou Bai Ju Yi Floor Manufacturing Co., Ltd., the affiliate of Hangzhou Singular Group, after Faus Timber Shanghai/CFL, Co. Ltd. ("Faus Shanghai"), Faus’s subsidiary based in Shanghai, China, commenced a patent infringement action against Hangzhou Singular and its affiliate in a Shanghai Court. On February 25, 2008, the Shanghai court issued an infringement verdict in favor of Faus.
Faus is pleased to announce that, by confirming the validity of the 02815741.9 Patent, the SIPO validated a patent with claims of essentially the same scope as its U.S. and other foreign counterparts. The 02815741.9 Patent is the Chinese counterpart of Faus's U.S. Patent No. 6,638,387, entitled "Embossed-In-Register Manufacturing Process," which issued on October 28, 2003. SIPO has determined that some of the claims of the 02815741.9 Patent have validity issues, but Faus is pleased with the 11 validated claims, which correspond to the claims of the '387 Patent. Faus is presently considering whether to appeal the SIPO's determination.
